VIRGINIA HILL UPDATE & FINAL JUDGMENT

          On April 15, 2010, Fourth District Judge, Donald Eyre, Jr., ruled on the final judgment against Defendants Jenson, Matthews, Apostolic United Brethren, and others.  The last paragraph of the ruling is quoted as follows:

4.  The total amount of the judgment against each of the above-named defendants, jointly and severally            , is $6,114,854.79, and Plaintiff is awarded judgment interest on the entire amount of $6,114,854.79, accruing from January 13, 2010, the date of the Court’s ruling, at the judgment interest rate of 2.41% per annum until paid in full.  Also, Plaintiff is awarded judgment for all costs, including reasonable attorney fees, necessary to collect and satisfy the foregoing judgment amounts.

            The ruling is a long time coming.  The offense took place in October 1989.  The civil investigation began in earnest in 1995.  The original complaint to recover the stolen 1.54 million was filed in 1997.  The matter was appealed to the Utah Supreme Court twice, with rulings favoring Virginia. 

            In 1989, the defendants were a cohesive priesthood cabal. Owen Allred and John Putvin are now deceased.  John Shugart, who the defendants attempted to make a third party defendant, is deceased.  Jim Sandmire and Jeff Norman have left the group.  Dennis Matthews, a kingpin in the theft, has been marginalized by the group.  According to reports he is now a “drone” living off the labors of others.  J. LaMoine Jenson succeeded Owen Allred as Presiding Elder.  Apostolic United Brethren continues to expand.  They are involved in acquiring 900 acres in San Pete County with enough water rights to support a township. 

            It is yet to be seen how willing AUB will be in making good this judgment.  It is expected that the priesthood ruling council will play a major role in how cooperative the Defendants will be.  According to rumors, Jenson is being pressured by militant priesthood subordinates opposed to cooperating in any form. 

            This nefarious, priesthood machination hatched out of the delusion that as God’s special envoy the AUB priesthood was above the law.  They were lulled by a false sense of “entitlement” and “illusion of invulnerability.”  This irrational phenomenon is a unique, “endemic mentality” similar to and rising from the same fundamentalist delusions that induced the FLDS to arrogantly take pubescent girls as plural wives in defiance of the laws of the land.

            AND ADDITIONAL NOTE:  As it concern Dale’s comment that polygamy is legal in Saskatchewan, I talked to a Canadian attorney the other day.  He said that the statute prohibiting polygamy is federal and applies to Saskatchewan as well as all the other provinces in Canada.  Sorry, Dale, but it appears you are wrong.
