Hill Lawsuit Update

          On June 24, 2010, 2pm, a hearing was held before Judge Eyre, Fourth District Court, Nephi, Utah concerning the legal fees entitled to the Plaintiff.   Cory Wall representing Virginia argued in behalf of the motion submitted by Don Redd asking for a “contingency” legal fee of $2 million.  Drew Briney, attorney for the defense argued that the attorney fees should be based on an hourly affidavit showing exactly what time Don Redd had spent on the case.  The Judge ruled in favor of Drew Briney.

            In addition to the hearing, Drew Briney turned over to Cory Wall documentation of Montana property that AUB was willing to turn over to Virginia Hill as partial payment towards satisfaction of the judgment.  Mr. Briney also turned over a check in an undisclosed amount as partial payment.

            The Judge was concerned that inasmuch as Virginia was awarded triple damages in the law suit an extra 2 million might represent an exorbitant amount when compared to the 1.54 million that was stolen from her. The Judge wanted to be fair.

            The significance of the June 24th hearing is that it was the beginning of the Defendant’s efforts to pay Virginia back.  However, Dennis Matthews, the person who got AUB involved in the first place, has shown no indication that he is going to make good the judgment against him – which is no surprise.
